Google Faces $5B Lawsuit Over Tracking the Incognito Mode

Google encountered the $5 Billion class-action lawsuit for allegedly tracking users browsing Chrome's incognito mode collecting users' browser history.

This Lawsuit allegedly says Google is in violation of privacy law for tracking and collecting the data of users in their Chrome's incognito mode.

Google is been trying to make the lawsuit dismissed from the last June of its filing. A federal judge ruled the lawsuit must proceed forward.

In this case, it has been stated the Google does not sufficiently provide full information about the collection of users' data in the incognito mode.

US District Judge Lucy Koh in San Jose, California, quote:

“The court concludes that Google did not notify users that Google engages in the alleged data collection while the user is in private browsing mode.”

In more detail, the users who filed this case have the major issue with Google collecting their data with some other forms of services while the users are in complete incognito mode. The other service like Google analytics has alleged concern of collecting the data of users when they are visiting the website in incognito mode.

The Users in filed case quote that they were under the impression that Chrome's incognito mode offered full privacy protection passing any data collection activity.

The Google company speaker  Jose Castaneda disputes the claims by providing the following statement:

“We strongly dispute these claims and we will defend ourselves vigorously against them. Incognito mode in Chrome gives you the choice to browse the internet without your activity being saved to your browser or device. As we clearly state each time you open a new incognito tab, websites might be able to collect information about your browsing activity during your session.”

Google says with the notes about the Consumer with the case agreed to Chrome's privacy policies which uncover the data collection activities.

Checking the Claims in the Lawsuit

So, after the lawsuit of the consumer against Google for the collection of data even after enabling the incognito mode in the Chrome browser. The Judge in the case makes the case clear to go forward on the grounds that Google does not inform the users about the collection of the data even in incognito mode.

Google tackles the claim by quoting that it does inform the users whenever they open the incognito mode that the data can be tracked and collected even they are in incognito mode.

Chrome's Incognito mode offers the prevention of the data being stored in the storage. It completely hides the user's activity from the other people who are using the same device.
